Man Files Lawsuit Against Popeyes Over Repeated Attempts To Score Their Sold-Out Chicken Sandwich: ‘I Can’t Get Happy’

Craig Barr of of East Ridge, Tennessee has filed a lawsuit against Popeyes over the “countless time wasted” trying to get one of their ultra-popular new crispy chicken sandwiches that sold out earlier this week. Apparently, a Chick-fil-A sandwich just won’t get it done for him.

Barr says he is suing Popeyes for “False advertising, deceptive business practices by entity to public.

Countless time wasted driving to and from Popeyes. No chicken sandwich. Was told to come back this day – still no sandwich.”

But wait, the story gets even better.

“I can’t get happy; I have this sandwich on my mind. I can’t think straight,” Barr told the Times Free Press on Thursday. “It just consumes you.”

After blowing a tire, damaging a $1,500 rim traveling to another Popeyes at the suggestion of one of the restaurant’s employees (they were also sold out), Barr even went so far as to answer a Craigslist ad from a man claiming he had a friend who worked at Popeyes and had stashed some of the sold-out chicken sandwiches in a walk-in freezer.

Barr met with the man behind the restaurant on Monday, handing him $25 — $5 for the sandwich and $20 for the troubles. The man allegedly went into the store and never came back. Barr went inside after realizing what happened. An employee said a man matching the description had bought something and left out the front door.

“I got scammed,” Barr said.

Barr claims Popeyes purposefully ran out of the sandwiches just to get all of the ensuing publicity and is seeking $5,000 in compensaton for his troubles.

Expect a class action lawsuit to also be filed any day now…
